Social Conservatives Get One Victory from Supremes

Today, Liberty Institute responds to the Supreme Court’s historic ruling in Obergefell v. Hodges, determining the future of marriage policy in America. As the largest nonprofit legal organization in the nation dedicated solely to defending religious liberty in America, Liberty Institute remains dedicated to defending the First Amendment rights of religious liberty for all  Americans.

“As today’s Supreme Court ruling recognizes, Americans have a constitutional right to speak and act according to their beliefs,” said Liberty Institute President and CEO Kelly Shackelford.  “In the marriage debate, many people of faith—from small businesses owners to students, soldiers, and chaplains—have been persecuted for their religious beliefs about marriage. We will not allow people of faith to be silenced or censured because of their religious beliefs, and we appreciate that the Court unanimously recognized the importance of protecting religious liberty in this area. Liberty Institute remains undeterred in our mission to defend and restore every American’s right to religious  liberty.”

In April, Liberty Institute filed an amicus brief at the Supreme Court highlighting the importance of protecting the First Amendment rights of people of faith in the marriage debate and asking for the Supreme Court to expressly affirm the First Amendment rights of Christian ministers, teachers, leaders, and ordinary Americans who are compelled by faith and conscience to preach or speak aloud their millennia-old and sincerely held religious view that marriage is the sacred union of one man and one woman. The Supreme Court unanimously, 9–0, granted the protection that Liberty Institute requested and recognized that, as Justice Kennedy said, “The First Amendment ensures that religious organizations and persons are given proper protection as they seek to teach the principles that are so fulfilling and so central to their lives and faiths, and to their own deep aspirations to continue the family structure they have long  revered.”
