Alliance Defending Freedom Celebrates Victory for Women’s Rights As Fifth Court Blocks Biden’s Title IX Overreach

In a victory for women’s rights and religious freedom, a federal district court in Missouri has become the fifth court to halt the Biden administration’s unlawful reinterpretation of Title IX. This latest ruling, secured by Alliance Defending Freedom (ADF) attorneys, marks another crucial step in protecting the integrity of women’s sports and spaces across the nation.

What is Alliance Defending Freedom?

Alliance Defending Freedom (ADF) is an alliance-building, non-profit legal organization committed to protecting religious freedom, free speech, parental rights, marriage and family, and the sanctity of life.

Alliance Defending Freedom Church & Ministry Alliance is a dedicated division of Alliance Defending Freedom, which focuses on providing legal support and counsel to religious organizations and ministries. Its primary goal is to protect the fundamental rights of faith-based groups, ensuring they can freely practice and express their beliefs without undue interference or obstruction from external sources.

The court’s decision, issued on July 24, 2024, grants a preliminary injunction in the case of State of Arkansas v. U.S. Department of Education. This lawsuit, filed by ADF on behalf of high school athlete Amelia Ford and six states, challenges the administration’s attempt to redefine the word “sex” in Title IX to include “gender identity.”

Alliance Defending Freedom CEO and President Kristen Waggoner warned of the dangers of this redefinition in a Wall Street Journal op-ed published in May. She accused the Biden administration of “disregarding biological differences between males and females, thereby ‘mocking Title IX’s promise of equality.'” Waggoner’s concerns about the administration “opening the floodgates for males to enter female spaces nationwide” are being addressed through these successful legal challenges.

Arkansas Attorney General Tim Griffin celebrated the ruling, stating, “Today’s ruling is a victory for women and girls in Arkansas and across the nation as yet again a federal court has stopped the Biden-Harris administration from going around Congress to implement a ridiculous, nonsensical, and illegal election-year move.” He emphasized that this injunction protects girls from having to share intimate spaces with biological males and preserves the fairness of girls’ sports competitions.

ADF Legal Counsel Rachel Rouleau highlighted the broader implications of this victory in a statement on Alliance Defending Freedom Media.

“The Biden-Harris administration’s radical redefinition of sex won’t just rewire our educational system. It means girls will be forced to undress in front of boys in gym class and locker rooms, girls will share bedrooms with boys on overnight school trips, teachers and students will have to refrain from speaking truthfully about biological sex, and girls will lose their right to fair competition in sports. The administration continues to ignore biological reality, science, and commonsense, and women are suffering as a result. The court rightly decided to enjoin the administration’s unlawful rule, which will protect fairness, safety, privacy, and free speech for students, teachers, and female athletes,” Rouleau said.

As the new school year approaches, these legal victories ensure that educational institutions can continue to respect biological realities and protect the privacy and fairness owed to female students.

As Waggoner aptly stated in her op-ed, “For the sake of America’s youth, particularly girls, courts should quickly block the administration’s unlawful mandate and protect the educational opportunities that Title IX promises girls and women.”
